    My First Closing Argument

    Wow, it has been a long time since I’ve used either the “Law School” or “Rhetoric” category tags.  This post fits into both categories, but mostly in the former.

    On Wednesday, I gave my first closing argument in a class called Civil Trial Advocacy.  Essentially, the class entails going through three mock civil trials to give students some “real world” experience. This type of class is usually called a lawyering skills class.  In a skills class you don’t really learn much law, or theory, but instead focus on the “art” of lawyering.  I took the class because it has been quite some time since I last spent serious time doing public speaking, so I thought what better way to get some practice in public speaking, where I was also learning the ropes of a civil trial.

    I have not been disappointed.  This has been my favorite class thus far in law school.  I’ve already had the opportunity to cross examine an expert witness, and this week I gave my first closing argument.

    I thought my closing argument went well, but the whole situation gives me the opportunity to talk a bit about rhetorical strategy. I was faced with a much more prepared adversary.  Seriously, who has some much time that they are able to prepare a 35 minute argument when we were only allowed 10 minutes?  To make things worse in my case the Judge let my opponent go on for the entire 35 minutes when I only had prepared for the expected 10 minute speech.  I think she should have been cut off much earlier, but she wasn’t so I was forced to rethink my strategy on the fly.

    In my experience in public speaking [which is admittedly somewhat limited] the following are speaking strategies I use when confronted with a much better prepared opponent in a speaking situation:

    1. Listen carefully to your opponent’s argument. Every position has it weaknesses.  The longer the explanation takes, the more the other person’s argument’s weaknesses are exposed.  Use this to your advantage.  Instead of trying to respond to every argument in turn, [which you  do not have time to do], try to highlight a couple of your opponents weakest arguments.  Directly reference these weaknesses, and then assert that they are representative of your opponents entire argument.  Hey, if they make a number of flimsy arguments, what makes the rest of their points reliable?  At the very least you’ll force your opponent to address this during rebuttal which will use up some of their remaining time.
    2. Take a more conversational approach. What ever you do, do not panic.  Try to personally identify with your audience.  Make eye contact, and speak slowly.  Most audiences don’t like to be lectured, therefore it is to your advantage to act calm and “converse” with the audience rather than hit them with every available argument.  Think about how you like to be spoken to while listening to a speaker.  Act accordingly.
    3. Make your opponent play on your turf. Latch onto your opponent’s terminology and turn their talking points to your key phrases.  Taking ownership of your opponent’s key terms shifts the attention from underlying issues to who is accurately portraying the meaning of the word.  This is especially effective when you opponent is incorrectly using a word, or using an uncommon use.  Either way if you opponent comes into this engagement relying on a few key phrases, show the audience why your side/point of view is actually a better representative of those phrases.
    4. Focus on the key points. Obviously the other person has said a lot more than you, but quantity does not equal quality.  Attempt to crystallize the key issue in your favor.  While your opponent may have thrown out every argument known to man, focus on slowly expanding your best argument to show that the key issue is falls on your side of the argument.  Of course this also implicitly means that you must suggest that THE key issue of the debate falls to your side.  Therefore make sure to pick an issue to pound away at that you can win.  A thorough explanation of one issue is much more convincing than cursory mention of several.  Remember quality is better than quantity.
    5. Ask for the sale. Let me repeat: ASK FOR THE SALE!  This is the one step that I forget most; yet it happens to be the most important.  Go figure.  Ask your audience to act, and let them know what you thing they should do next.  Your best arguments are wasted if you don’t take this last affirmative step to tell a convinced listener what actions they should take next.  No matter what your field: Law, Business, Consulting, Sales, Education, whatever; you must tell your audience what they ought to do.  Otherwise what is the point of you being up there speaking?  Ask for the sale.  Ask the audience to choose you.

    Again these are just some of my personal strategies which I employ when debating something in public [well I guess sometimes in private as well, but that's just not as interesting].   Not all are effective at all times.  I tried to use 1-4 this week during my closing argument which worked out pretty well.  Remember, I only had 10 minutes to counter a 35 minute argument.  You are forced at times to pick your battles.  Unfortunately,  I forgot about Asking for the Sale, which was a huge blunder which was then pointed out by the Judge later.  Yuck, don’t put yourself in that situation.  Never forget that step[Note to self . . . ].

    The Baseball Post: Spring Training

    Spring training really begins for the Twins tonight with their first actual game against their cross town rivals [at least in Ft. Meyers, Florida] the Boston Red Sox.   There isn’t any sound like a bat hitting a ball which I associate more closely with summer.  Suffice it to say: I am extremely excited that baseball is back.  Its really quite an irrational feeling, but I refuse to do anything to temper it.

    I can only imagine what it must feel like to be a young player at Training Camp, working on your skills alongside of some of the greatest baseball players in the world.  Many of these rookies are actually learning from their childhood idols and heroes.  How cool would that be?  So for the next couple of weeks we have a mini baseball season consisting of 35 games.  Its always exciting to see who makes the team by playing well enough to impress the coaches in those games.  Baseball’s back.

    The only downside, is that Boof Bonser, one of my favorite Twins pitcher, underwent surgery this morning, and the found injuries they never dreamed would have been there.  So it looks like Boof will be out for the majority of the 2009 season if not more.  At least he has one of the coolest names around; I wish all the best to Boof, and hope for a speedy recovery.

      Go-go. Though call. I think he'll improve, but will likely see less playing time this year because of the Twins outfield situation [barring injury or trade]. I think for fantasy purposes I would stay away, but if you like steals and are willing to use a low round pick to see if he learn better plate discipline soon he might be worth the risk.

      I love him in the Twins lineup. I enjoy watching him play; he has a lot of passion for the game.

    James Ackerman is the wine manager for Georgetown Wine and Spirits, but right now he has a beer problem. He can’t sell singles in sizes less than 70 ounces because the drunks went and ruined it for everyone. They pissed once too often in the wrong people’s yards until D.C. Council members, sympathetic to ANC Commissioners bitching about piss and puke and vagrants on their property, decided last year to ban single beer sales in both Wards 2 and 6. The law officially went into effect on Feb. 9.

    Yikes! I’m not sure whether or not single beers should be sold here in DC, but man after reading the story I wonder how effective and fair the law will be in its current form.  No one contacted, including those who helped to write the law, seems to know what to do, or how to apply the new law.

    Just by chance I happened to buy a single beer yesterday at our local Cleveland Park Liquor Store, and I must say I would miss the opportunity to do so.  I love trying new beers.  And frankly, I’d rather not worry about having to buy a bunch of beer I may not like.  What better way is there to explore the world of beer, than to try it for yourself?  In order for that exploration to take place it must be cost effective, especially considering today’s economy.  The only way it can be cost effective for me is if I can purchase singles which are probably smaller than 70oz.  Hopefully the DC Council doesn’t decide to expand the new law beyond its current borders.

    What do you think?  Should store owners be allowed to sell single beers?

      Are they going to outlaw single-beer sales in bars? Do you have to buy by the pitcher? That's just idiotic.

      thank god for the Metro. You can still get out to Paul's in Friendship Heights, which was my liquor store of choice back in the day (very nice wine selection; I don't remember much about the beer, unfortunately).

      Apparently, Chevy Chase Wine & Spirits is the place to go for beer.

    I know absolutely nothing about Mary Wakefield.  Well I guess that is not entirely accurate.   I know these things largely thanks to the linked article:

    1. Wakefield is from North Dakota;
    2. She was trained as a nurse, and has her Ph.D. from the University of Texas;
    3. She directs the Center for Rural Health at UND, where she is an expert on rural health;
    4. She’s worked in Washington DC before in capacities including Chief of Staff for Sen. Kent Conrad;
    5. She will oversee 7,000 community clinics.

    Congratulations on your appointment Mrs. Wakefield.  I am convinced that what is good for North Dakota is good for me, so even though I would guess Mrs. Wakefield and I wouldn’t see eye to eye on every issue, I am confident she will do a  good job.

    Clearly this is homer-ism, but hey I like seeing ND in the news and this will only give me another reason to post news stories about the greatest state admitted to the union in 1889.

    My 2009 Twins Jersey 

    Just thought I would share the Jersey I will be rooting for the Twins in for the duration of the 2009 Season:

    That’s right. Even thought the Twins signed Joe Crede to a one year deal today I’m sticking to my guns. I’ll be rocking a Delmon Young jersey all season, so long as he remains a Minnesota Twin. Why? Everyone else is wearing Mauer, Morneau, Nathan, Gomez, etc. I’m pretty sure I’ll be the only person in Washington DC walking around in a MN Delmon Young jersey.

    I’m not even sure they’ll be wearing these around the Twin Cities these days.  Good times.

    Grain Belt 

    I’m back in Fargo for the weekend running around getting ready for a May wedding. Frankly it’s more work than I anticipated.

    Fortunately one of the perks of being in the great plains is that I get to enjoy the regional brews. Enter Grain Belt Premium. Sitting down to relax after a long day of running around town was the best way to unwind.

      Premo is sort of like the Minnesotan PBR, in that it's very cheap and beloved by hipsters. I think it tastes a lot better than PBR, and, sorry Andrew, wayyyyy better than High Life.

      It's basically my go-to beer when I go out, because every single bar has it on tap. But a word of warning: don't ever get it in a can. It's terrible.

      Nice! This worked! It took longer than I wanted to set up, and I all but gave up yesterday. Spent 15 minutes setting everything up again today [in a somewhat different manner] and now everything seems to be working fine. [Except for my WP-Twitter plug in, but that isn't a big deal.]

It happened to be live at a Summer festival and I was impressed how good they were live.

    I’m surprised I haven’t more country and old music on these lists yet, but if I had to pick someone representative of that group, Garth Brooks would be my choice. If you didn’t see him perform during the HBO’s Pre-Inauguration Concert, you missed out.
